The primary election of city officers shall be held on the first Tuesday in August of every odd numbered year. The general election of city officers shall be held on the Tuesday succeeding the first Monday in November of every odd numbered year.

The next primary election shall take place on the first Tuesday in August 2017. The next general election shall take place on the Tuesday succeeding the first Monday in November 2017, and succeeding elections will be held every two (2) years for all city officials positions whose terms have expired.

In case of a vacancy in the office of mayor, the president of the council shall become mayor until the next regular election for that office and a vacancy shall occur in the office of the council member becoming mayor. In case of a vacancy in the council occurring by reason of resignation, death, removal from office or from the City, or any other reason, the mayor, by and with the advice and consent of the remaining council members, shall appoint an elector to fill the vacancy until the next election for that office. In case any person elected as a council member neglects or refuses to qualify within thirty (30) days after election, the council member shall be deemed to have refused to accept such office and a vacancy shall exist. Thereupon the mayor may, with the consent of the remaining council members, appoint a suitable elector to fill the vacancy.

The election of city officials shall be conducted in all respects as provided by the laws of Kansas governing the holding of city elections.

At all city elections the polls shall be open at 7:00 a.m. and close at 7:00 p.m., unless different hours are set and publicly announced by the county election officer.

(a)   The regular term of office for a mayor or city council member elected in 2021, and all years thereafter, and the date for swearing in of the elected official, following certification of election, shall be the first regular meeting on or after December 1, 2021, and on or after December 1st of each election year thereafter.

(b)   Every person elected or appointed to city office, before entering upon the duties of such office, shall take and subscribe an oath or affirmation as specified in K.S.A. 54-106, and amendments thereto, and every such oath or affirmation shall be filed with the city clerk.

(a)   Any person desiring to become a candidate for city office elected at large in the city shall file with the Kearny County election officer, before the filing deadline, established in K.S.A. 25-205, and amendments thereto, a declaration of candidacy on a form furnished by the Kearny County election officer, as specified by the secretary of state.

(b)   The filing shall be accompanied by a filing fee of five dollars ($5) or, in lieu of such filing fee, by a petition signed by twenty-five (25) qualified electors of the city, or by a number of such qualified electors of the city equal to not less than ten percent (10%) of the ballots cast in the city at the last general city election, whichever is less.

All elections for members of the governing body of the City of Deerfield, Kansas, shall be nonpartisan.
