(a) It shall be unlawful for any person to fire or discharge , within the city limits, any firecrackers , Roman candles , sky rockets, pinwheels, pistols, canes, cannons or other appliance using blank cartridges, or any substance or articles of an explosive nature designated or intended to be used for fireworks, at any time during the year, except on the days of June 27th through July 3rd, and July 5th, of each year between the hours of 8:00 a.m. and 10:00 p.m., and on July 4th of each year between the hours of 8:00 a.m. and 12:00 midnight. Fireworks shall not be fired or discharged at any time in the following zoning districts within the city: C1, C2, C3, C4, I1, I2 and P.
(b) It shall be unlawful for any person, firm or corporation to sell fireworks to individuals in this city, at any time during the year, except on the days of June 27th through July 5th of each year between the hours of 8:00 a.m. and 12:00 midnight.
(c) It shall be unlawful for any person, firm or corporation to sell fireworks in the city, on any lot, parcel of ground, within any building or small stand without a permit.
(d) Any person, firm or corporation desiring to sell fireworks in the city, shall make application with the city clerk for a permit. Such application shall be accompanied by a written authorization from the owner of the lot, parcel of ground or building that the applicant is desiring to sell fireworks from. Application for permits shall be submitted to the city clerk on or before June 1 of each year. All applications will be considered by the city council no later than the regularly scheduled meeting of the city council in June of each year.
(e) The sale of fireworks as specified in this section shall only be allowed in areas zoned CO, C1, C2, C3, I1 or I2.
(f) All buildings or small stands temporarily placed, to be used as a place where fireworks will be sold shall be inspected by the fire chief and shall have a fire extinguisher accessible at all times.
(g) It shall be unlawful for any person or persons to fire or discharge fireworks, within fifty (50) feet of any retail fireworks stand, in or on any alley or within the fire zone of the city.
(h) All small stands that are temporarily placed in any CO, C1, C2, C3, I1 or I2 area and used for a place to sell fireworks shall be removed from the lot or parcel of ground by midnight on July 6th of each year.
(i) It shall be unlawful for any person, firm or corporation to sell fireworks within two hundred (200) feet of any gasoline or fuel pump, filling station, bulk station or any building in which gasoline, fuel, or volatile liquids are sold.
