A CHARTER ORDINANCE OF THE CITY OF DEERFIELD, KANSAS, EXEMPTING THE CITY FROM K.S.A. 12-4112, PERTAINING TO THE STATUTORY PROHIBITION FOR ASSESSING COURT COSTS IN THE MUNICIPAL COURT OF THE CITY; PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THAT SUBJECT.
BE IT ORDAINED by the Governing Body of the City of Deerfield, Kansas:
SECTION 1. Exemption from Statute. The City of Deerfield, Kansas (City), by virtue of the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to and does exempt itself and make inapplicable to it, K.S.A. 12-4112, which applies to the City, but is part of an enactment which does not apply uniformly to all cities in the State of Kansas.
SECTION 2. Municipal Court Costs.
(a) Court costs and other costs for the administration of justice may be assessed against any accused person in any municipal court case and such costs shall be determined by ordinance; provided, however, no court costs shall be assessed against an accused person found "not guilty".
